Acceptance of general conditions of sale

These General Terms and Conditions of Sale (hereinafter referred to as GTC) are available to the buyer on the homepage of the website www.littlewood.fr, as well as on most related pages. Any order made via the website www.littlewood.fr, by phone or by e-mail to "La Cave Littlewood" implies unreserved acceptance by the buyer and full acceptance of these terms and conditions and is irrevocable and not subject to change. These Terms therefore exclude all other documents such as promotional card, prospectus, press, catalogs or e-mail, issued by the seller and which therefore have only indicative value.

Our offers are exclusively reserved for a particular major customer, and capable. Therefore, in accordance with article L. 3342-1 of the Public Health Code, you undertake, by placing an order on the website, to be eighteen (18) years old at the date of the order. In addition, you declare that you have the legal capacity to place an order on the site.

 

Order

Orders are only final when the goods ordered and the shipping costs have been fully paid to the seller. Offers are subject to availability.
All the wines indicated on the site are in our possession on our premises. The bottles offered on the site are sold as is. A picture of the actual bottle is always available on the product page. If several bottles are available for a reference, the picture represents the bottle in worse condition. If information about the condition of the bottles is to be reported, it is included in the description of the product sheet, without, however, assuming liability in the event of an error or omission. If you have any doubts, we will be pleased to provide you with more pictures. The pictures, as well as the evaluations on the products are given for information only and do not have contractual value. A difference in the color or appearance of the bottles may result, in particular, from the quality of the photographs or from their date of shooting.

The data recorded by the site constitute proof of all orders.

The seller reserves the right to refuse any order in the following exceptional cases:

- a customer with an ongoing litigation with "La Cave Littlewood" and its website www.littlewood.fr

- in the circumstances that the user of the service is not an individual but a professional.

If the buyer does not want immediate delivery, the seller can keep the items included in the order on behalf of the customer for 15 working days (3 weeks) after the date of the order. After this time, the bottles will be put back in stock, the buyer will be refunded the total amount of his order and the availability of the products will no longer be guaranteed for the original purchaser.

Cancellation policy

The buyer has a right of withdrawal after the conclusion of the order. He has 14 days from the date of delivery to demonstrate his willingness to withdraw from "La Cave Littlewood". This can be an email or a letter with acknowledgment. The buyer will then return the property within 14 days of the withdrawal notice in the original packaging at his own expense. The buyer will then be reimbursed for the price of the order and the standard delivery costs (corresponding to the initial delivery of "La Cave Littlewood" to the buyer). A refund will be made if, and only if, after receipt and verification of the returned order, no signs of damage have been found and the bottle (s), have retained their identical integrity at the time of shipment (uncorked , Capsule intact, ...). If the buyer had chosen a more expensive delivery method than the standard delivery, the refund of the delivery costs will only correspond to the amount of a standard delivery. In case of dispute, it will be for the buyer to prove that he has expressed his will to retract within the legal period of 14 days after delivery of his order.

 

Responsability ofthe seller

 In the event of product degradation due to transport conditions, or conditions of inappropriate storage of the product (temperature, humidity, exposure to light ...), the seller can not be held liable. Moreover, we can not guarantee the taste quality of old vintages (10 years older than the order year. For exemple : a vintage older than 2007 for an order in 2017)). In accordance with international practice, La Cave Littlewood is not obliged to take back or exchange corked bottles. On the other hand, we are at your disposal to indicate the conditions of good preservation of the products ordered.

 

Liability in the event of failure of the website or suspension of service

La Cave Littlewood declines all responsibility in the event of interruption of the access to the website, and/or any malfunctioning or technical failures whatever they are, and whatever their duration or frequency. It is reminded that any user can contact us by phone or e-mail in order to place an order.

 

 

Penalty for late payment and indemnity

 In the event of late payment, a penalty for late payment at the statutory rate, as well as a lump sum indemnity for recovery costs of 40 euros will be charged to the offending buyer (article D. 441-5 of the Commercial Code)

 

Promotion & Discount

Promotions and discounts granted to an order are not cumulative and limited to one per household (same name and/or address).

Promotional codes are not cumulative. Only one code per transaction can be used. The seller reserves the right to refuse any order that does not respect these conditions.

 

Delivery

To date, La Cave Littlewood proposes delivery to metropolitan France and Corsica. For any order outside France, we can send you a quote according to the weight of your order, the carrier chosen, the legal terms and, of course, the place of delivery (country or DOM / TOM). Delivery times are indicative, and run from the receipt of the full payment of the order, and its postage. Delays in delivery can not give rise to any penalty or compensation of any kind whatsoever nor to the cancellation of the order. Shipments are made from Monday to Friday after a delay (less than 24h) of preparation of the Commissioned by our teams. The order will be sent to the address indicated during validation. In the event of an error in the addressee's details, the seller can not be held responsible for the inability of the carrier to carry out the delivery of the order.

We do not deliver sparkling wines, champagne, etc. to Germany and Austria. If an order to these countries includes an effervescent wine, the latter will be canceled and the customer will be asked to re-order without the bottles concerned.

The amount of shipping costs will vary according to the type of transport retained and the place of delivery.

"Mondial Relay" delivery : By choosing the "Mondial Relay" mode, your package will arrive in 3 to 5 working days in the relay point you have selected, after final validation of your order by our services. It will be up to you to retrieve your parcel by you in the relay point. We would like to draw your attention to the fact that your package is not insured with Mondial Relay. The package and its contents travel at your own risk, and La Cave Littlewood can not be held responsible for any damage, loss or damage to your package and/or its contents. Delivery on Reims (51100, France): By choosing the "Delivery on Reims" mode, you will receive your order within 5 working days after definitive validation of your order by our services. You will be contacted by a member of our team to select a date and time range. This delivery service is free, with no minimum order amount. The cities eligible for free delivery are: Reims, Betheny, St-Brice-Courcelles, Tinqueux, Champigny, Bezannes, Cormontreuil.

If the recipient is not present at delivery on the day of delivery, within the time range agreed between our team and the latter, the second presentation will be made at a flat rate of 15 €.
 

If a month after written complaint from the customer, the goods have still not been delivered, the sale can be resolved at the initiative of either party.

Important : Goods always travel at the recipient's own risk.

Upon receipt of the order, it is the responsibility of the buyer to scrupulously check the condition of the goods and to make any necessary comments in case of breakage, damage or lack, expressing his reservations on the delivery note. In case of breakage, you must refuse the parcel to the deliverer. In all these, it is imperative to inform us in 24 hours with the coordinates indicated on the site. No claim can be made beyond this deadline.
Each package includes "value" insurance in case of loss of the package, or breakage (except for Mondial Relay). It should be made clear that neither the insurance nor the seller does not take care of the possible defects of sealing of the plugs on the old vintages.

In accordance with the provisions of Article L. 441-6 of the French Commercial Code, as in force on 1 January 2013, any order not paid within 30 days of the due date shall be increased by the legal interest rate plus three points . Delay penalties are payable without recall. As stipulated in Decree No. 2012-115 of 2 October 2012, a lump sum indemnity in the amount of € 40 will be added, and due for collection costs in case of late payment.
